User: any natural person who accesses the website of MAZONIA .
Buyer: user who validated an order on the website MAZONIA .
For the application of these general conditions of sale, it is agreed that the user and MAZONIA will be collectively referred to as the “Parties”. The user who validated an order will then be called “buyer”. The rights and obligations of the user necessarily apply to the buyer.
The user who would like to purchase on the site declares to be over 18 years old and to have full legal capacity or to benefit from the authorization of a person holding parental authority, a guardian or a curator to be able to make purchases on the site.
Any order for an item offered on the site requires consultation and acceptance of these general conditions of sale (hereinafter referred to as “CGV”). The buyer's acceptance will be evidenced by checking the box “I have read and accept the general conditions of sale”.
These General Terms and Conditions apply without restriction or reservation to all sales concluded by MAZONIA from non-professional buyers, wishing to acquire the products offered for sale by the seller on its website mentioned above.
The General Conditions of Sale are accessible at any time on the website of MAZONIA and will prevail, where applicable, over any other version or any other contradictory document.
Access to the site MAZONIA is carried out under normal internet connection conditions. No additional connection costs will be charged to the user.
MAZONIA reserves the right to modify these General Terms and Conditions at any time and without notice. The applicable conditions are those in force on the date the order is placed. If the General Terms and Conditions are modified, they will be applicable as soon as they are posted online and will apply immediately to any new order. Editing and saving these conditions is the responsibility of the buyer. Article 2 – Validation of an order
2.1 – Navigation within the site

2.2 – Registration and password

Each time such emails or SMS are sent, the user will have the possibility to unsubscribe from the distribution list of future messages by following the procedure indicated in said messages.
2.3 – Registration of an order
Once online registration has been completed and/or after the user has logged in to the site, the user has the option of placing an online order from the online catalog. For the order to be validated, the buyer must first accept the General Conditions of Sale by checking the box provided for this purpose.
For the buyer's order to be taken into account, the buyer must provide all useful and necessary information for its processing.
At any time the user can:
- Obtain a summary of the items he has selected by clicking on “my basket”;
- Continue to select items by clicking on “continue shopping”;
- Complete your item selection by clicking on “place my order”
Once the user has been identified, to place an order, they must validate the order summary which will specify: the nature, quantity, price of the item(s) selected by the user; the amount of delivery costs; the order total; the user's contact details and delivery address.
Any order will constitute acceptance of the prices and description of the products available for sale.
In some cases, such as non-payment, incorrect address or other problem with the buyer's account, MAZONIA reserves the right to block the order until the problem is resolved.
If an ordered product is unavailable, the buyer will be informed by email. The cancellation of the order for this product and its possible refund will then be made, the rest of the order remaining firm and final.
Article 3 – Territories concerned
It is not possible to place an order to a country not included in the list of destination countries authorized by MAZONIA : mainland France; Germany ; Austria; Belgium ; Bulgaria; Cyprus; Croatia; Denmark; Spain; Estonia; Finland; Greece; Hungary; Ireland; Italy ; Latvia; Lithuania; Luxembourg; Malta; The Netherlands ; Poland; Portugal; Czech Republic ; Romania; United Kingdom ; Slovakia; Sweden ; Swiss ; Slovenia.
Article 4 – Contact available to the user
Once an order has been placed, the user will be able to query MAZONIA through the contact address of MAZONIA : contact@mazonia.fr. Any questions from the user relating to the product, its delivery, after-sales service, the right of withdrawal or any other reason will be transmitted to the managers of MAZONIA .
Article 5 – Product prices
MAZONIA will determine the price of its products which it may freely set in compliance with applicable laws and regulations.
The price of the products will be indicated in euros, all taxes included, excluding delivery costs.
The amount of delivery costs for each product will be added before validation of the order by the User.
Product prices are never negotiable by the User and may be modified at any time. Under no circumstances can this price change be applicable to an order already validated by the User.
Article 6 – Payment of products by the user
6.1 – Payment method
Payment methods are communicated to the user at the start of the order process at the latest. Payment will only be made online by card (Blue, Visa, Eurocard, Mastercard) from the organization chosen by MAZONIA such as Stripe.
6.2 – Payment deadlines
Payment will be made in one go and validates the order: no delay will be granted to the user.
The transaction will appear in the buyer's bank account according to the conditions of their banking organization. The deadline may vary from one organization to another.
6.3 – Failure to pay
Payment is necessary to validate the order. Payment is secured by the Stripe organization. An order will be considered void in the event of non-payment by the user. The product will then not be shipped.
MAZONIA reserves the right to cancel an order if non-payment is detected after validation of the order. MAZONIA will inform the buyer concerned by email.
6.4 – Billing
Each order will be the subject of an electronic invoice that the buyer will receive by email.
Article 7 – Discount vouchers
7.1 – Delivery of discount vouchers
On exceptional occasions, MAZONIA may be required to issue discount vouchers which will be sent on certain special occasions to certain users or potential users. Their amount and method of delivery will vary depending on the occasion. Generally speaking, people who are already users will be informed by email of the allocation of a reduction voucher as well as its value.
The discount voucher is valid for one year from its date of issue.
To use their discount voucher, the buyer must enter the code provided in the appropriate field before finalizing their order. The user must keep each code communicated: in the event of loss, MAZONIA will not be able to communicate them again.
7.2 – Conditions of use of discount vouchers
Unless otherwise indicated, particularly related to the use of a discount voucher when registering a first order, several vouchers can be used on the same order.
Under no circumstances can they be converted into foreign currency.
The vouchers issued have an expiration date that cannot be changed.
No new voucher may be issued or allocated to a user to replace an expired and unused voucher.
The application of a voucher necessarily implies that the value of the basket, before the calculation of delivery costs, is greater than the value of the voucher except in the case where the special conditions of use of said voucher specify a minimum purchase amount. (before calculating delivery costs). In this case, the value of the basket (before calculating delivery costs) must be greater than the value of the minimum purchase required to use the voucher.
A buyer may under no circumstances request MAZONIA to deduct from an order already validated and paid for the value of a voucher whose code has not been entered, selected or which is defective when it was placed.
Vouchers are only valid on site MAZONIA .
7.3 – Use of vouchers
In order to benefit from the reduction associated with a voucher, the user must enter their code assigned to them in the window and box provided for this purpose. After entering the voucher, the user must validate by clicking on the “validate” or “ok” button. The discount will be immediately deducted from the order amount.
7.4 – Reimbursement of an order containing a voucher
When an order contains a voucher, the voucher amount is subtracted from the order total before delivery costs are applied. The refund of an item in an order, whatever the reason, is made after deduction of the share of the correct associate which will then be recredited to the customer account.
Article 8 – Delivery of products by the seller
Deliveries are ensured by the services of Chronopost, DPD, UPS or DHL, from Monday to Saturday, depending on the option chosen by the Customer when validating their Order.
Delivery means the transfer to the Customer of physical possession of the Products .
The Delivery costs applicable to the Order are those mentioned on the Site at the time of the Order .
When MAZONIA takes care of the delivery of the Product, the risk of loss or deterioration of the Product is transferred to the Customer at the time of Delivery.
As an exception, the risk is transferred to the Customer when the Product is handed over to the carrier when the latter is responsible for transport by the Customer and not by MAZONIA .
Delivery is made to the delivery address indicated by the Customer, it being specified that this must be the residence address of the Customer, of a natural person of his choice or of a legal entity (delivery to his company ). Delivery cannot be made to hotels or to post office boxes.
If it is impossible to carry out the Delivery, due to an incorrect delivery address or the absence of collection by the Customer of his Order from the selected collection point or from Chronopost, no reshipment can be carried out and the Customer will be reimbursed within five (5) days from receipt of the Order by MAZONIA .
MAZONIA delivers Orders within a maximum period of thirty (30) days for Delivery in Metropolitan France and for international Delivery, this period being counted from the first working day after validation of the Order. The day after a collection is put online and from November 23 to December 31, the Delivery time may be increased by ten (10) days, given the large and exceptional volume of Orders.
In order for these deadlines to be respected, the Customer must ensure that they have communicated accurate and complete information concerning the Delivery address (such as, in particular: street number, building number, staircase number, access, names and/or intercom numbers, etc.).
MAZONIA cannot be held responsible for delays in delivery which are not its fault or justified by a case of force majeure (as defined below).
If the Delivery time is exceeded, the Customer may request the cancellation of the sale and obtain, within a maximum of fourteen (14) days of his request to this effect, the reimbursement of the sums paid on the occasion of the Order. Notwithstanding the above, MAZONIA cannot be held responsible for the damaging consequences resulting from a delay in delivery, only reimbursement of the Product by MAZONIA being possible to the exclusion of any other form of compensation.
Deliveries can also be made to a Relay Point by the Chrono Relais service provider, subject to acceptance of the package by the selected Relay Point.
Article 9 – Rights of withdrawal
The buyer has a period of twenty-one days to exercise his right of withdrawal, without having to give reasons for his decision or to bear any costs other than those provided for in the articles L. 121-21-3 to L. 121-21-5 .
The 21-day period mentioned above runs from the day the order is validated by the buyer.
Upon receipt of the product by the buyer a new period of 21 days from the day of receipt is allocated to the buyer to exercise his right of withdrawal.
In the case of an order for several goods delivered separately or in the case of an order for a good made up of lots or multiple pieces whose delivery is spread over a defined period, the period runs from receipt of the last good or batch or the last piece.
The buyer will return the goods to MAZONIA concerned no later than twenty-one days following communication of their decision to withdraw.
The consumer does not bear the costs of returning the goods: they will be borne by MAZONIA . This clause is only valid in the case of a return made from mainland France.
Exercising the right of withdrawal will result in the reimbursement of the order by MAZONIA , except in the event of depreciation of the goods resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of these goods.
The buyer will inform MAZONIA of his decision to withdraw by sending him a message to the contact address MAZONIA , unambiguous, expressing his desire to retract.
The burden of proof of exercising the right of withdrawal under the conditions provided for in this article rests with the buyer.
Items delivered subject to withdrawal must be returned in their original packaging to the address which will be communicated to the buyer.
Items must be returned in new condition and fit for resale. They must be accompanied by all their accessories, instructions for use and documentation.
The returned items must have been subject to minimal use, that is to say, have been tried on for a few minutes and must not show signs of prolonged use.
If the above conditions are met, MAZONIA will reimburse the buyer within a maximum of twenty-one working days from the date of receipt by MAZONIA , the sums paid by the buyer when placing their order.
Article 10 – Complaints
User can contact MAZONIA via the contact address “contact@mazonia.fr”. Any questions from the buyer relating to the product, its delivery, after-sales service, the right of withdrawal or any other reason will be transmitted to MAZONIA through this means.
Article 11 – Returns
During an exchange of an item relating to the same product (identical or different size; identical or different color), if the price of the product in question had decreased during the time interval having elapsed between the purchase and the return, no refund of the price difference will be made.
The risks associated with reshipment are the responsibility of the buyer. Therefore, it is up to him to keep all evidence of this return.
In mainland France, the return cost is borne by MAZONIA . Outside mainland France, the return cost is borne by the buyer.
Proof of reshipment must include the recipient's address as well as the date of shipment and the package number.
Article 12 – Proof, conservation and archiving of transactions
Computerized records, kept in the computer systems of MAZONIA under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.
The archiving of purchase orders is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with article 1379 of the Civil Code.
In all cases, the online provision of the bank card number and the final validation of the order will constitute proof of the entirety of said order, in accordance with the provisions of article 1316-1 of the Civil Code and will constitute due payment of the sums corresponding to entering the items appearing on the order form.
This validation constitutes signature and express acceptance of all operations carried out using the online store. However, in the event of fraudulent use of their bank card, the user is invited, as soon as this use is noted, to contact MAZONIA via the contact email address.
Article 13 – Illicit or contentious content
MAZONIA reserves the right to delete any information or obviously illicit content mentioned on the site. Users are invited to advise MAZONIA of any type of information or illicit or contentious content via the contact email address.
Article 14 – Force majeure
Any circumstances beyond the control of the parties preventing the execution of the normal conditions of their obligations are considered as causes of exemption from the obligations of the parties and result in their suspension.
The party invoking the circumstances referred to above must immediately notify the other party of their occurrence as well as their disappearance.
Force majeure is considered to be any irresistible fact or circumstance external to the parties, unforeseeable, inevitable, independent of the will of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts.
Expressly, are considered as cases of force majeure or fortuitous event, in addition to those usually retained by the jurisprudence of the French Courts and Tribunals, the blocking of means of transport or supply, earthquakes, fires, storms, floods, lightning, shutdown of telecommunications networks or difficulties specific to telecommunications networks external to the customer.
The parties will come together to examine the impact of the event and agree on the conditions under which the execution of the contract will be continued.
If the force majeure lasts for more than three (3) months, these general conditions may be terminated by the injured party.
Article 15 – Product guarantees
15.1 – Commercial guarantee
As MAZONIA products are handmade, variations are to be expected in size and patterns, compared to the photos presented on the MAZONIA website.
In the event of a defect in the item sold, the buyer must keep the purchase invoice sent by MAZONIA and contact customer service MAZONIA who will inform him of the procedure to follow.
In any event, the commercial warranty will be refused for any product modified, repaired, integrated or added by the buyer or any other person not authorized by the supplier of said product or service. It will not take charge of products damaged during transport or during misuse.
15.2 – Legal guarantees
It is indicated that the buyer will be able to choose between repair or replacement of the good subject to the conditions of cost and availability of the item, provided for by article L211.9 of the Consumer Code.
MAZONIA is required to deliver goods that comply with the contract and will be responsible for any lack of conformity existing upon delivery.
The item suitable for the use usually expected of a similar item and, where applicable, corresponding to the description given by the seller is suitable for consumption and must:
- Possess the qualities that he presented to him in the form of a sample or model;
- Present the qualities that a buyer can legitimately expect in view of the public declarations of the seller, the producer or his representative, in particular in advertising or labeling;
- Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer brought to the attention of the seller and which the latter has accepted.
As part of its legal guarantee of conformity and in the event of a lack of conformity during delivery of the item, MAZONIA undertakes:
- Either to replace the product for the buyer with an identical product depending on available stocks at the express request of the buyer,
- Either to exchange a product or service for a product of equivalent quality and price depending on available stocks upon acceptance by the buyer,
- Or to reimburse the price of the product or service ordered within thirty (30) days following the buyer's request if replacement of the identical product is not possible or equivalent.
If repair or replacement of the goods is impossible, MAZONIA may return the goods and have the price refunded or keep the goods and have part of the price returned, the amount of which will be previously determined by MAZONIA.
The same option is offered to the buyer:
- If the solution requested, proposed or agreed pursuant to article L211.9 of the Consumer Code cannot be implemented within one (1) month following the buyer's complaint; Or
- If this solution cannot be done without major inconvenience for him given the nature of the property and the use he seeks.
The sale may, however, be canceled if the lack of conformity is minor. The action resulting from the lack of conformity is prescribed two (2) years from the delivery of the goods.
The provisions of this section do not deprive the buyer of the right to exercise the action resulting from redhibitory defects as it results from articles 1641 to 1649 of the Civil Code or any other action of a contractual or extra-contractual nature which is recognized to him by the law.
15.3 – Guarantee against hidden defects provided for by articles 1641 et seq. of the Civil Code
The following articles are recalled:
Article 1641 of the Civil Code: “The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have it not acquired, or would have given only a lower price, if he had known them. »
Article 1645 of the Civil Code: “If the seller knew of the defects in the thing, he is liable, in addition to restitution of the price he received, for all damages to the buyer. »
Article 1646 of the Civil Code: “If the seller is unaware of the defects in the item, he will only be required to return the price, and to reimburse the buyer for the costs incurred by the sale. »
Article 1648 paragraph 1 of the Civil Code: “The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect. »
For any request concerning legal guarantees, the buyer must contact the customer service of the MAZONIA company via the contact address "contact@mazonia.fr".
As part of the guarantee of defects in the item sold, MAZONIA , after evaluation of the hidden defect and according to the buyer's choice, undertakes:
- Or to reimburse him for the entire price of the returned product
- Either to return part of the price determined by MAZONIA , if the buyer asks to keep it
Article 16 – Liability
16.1 – Product information
For each item on sale on the site, MAZONIA undertakes to provide a descriptive sheet to present its essential characteristics. MAZONIA makes every effort to provide the user with as much information as possible allowing them to know the items before registering their orders.
Despite all the care taken in writing these descriptions, an error could occur. If the user notices an obvious error, they can contact customer service to inform them. MAZONIA then undertakes to correct these errors as quickly as possible.
MAZONIA sells premium quality items. The products are made by hand. It is therefore impossible to ensure homogeneity of the articles. Therefore, it is normal to notice differences between the item photographed and the item delivered. This also applies to all handmade items on the MAZONIA website.
16.2 – Liability
The responsibility of MAZONIA is limited to the amount of the buyer's order.
The responsibility of MAZONIA cannot be held responsible for all the inconveniences or damages inherent in the use of a computer [tablet, telephone or any other means allowing access to the internet], a computer network or the internet. Notably, MAZONIA cannot under any circumstances be held responsible for a breakdown in service, an external intrusion or the presence of a computer virus. MAZONIA has only an obligation of means for all stages of access to the site, in particular consultation, form filling, placing an order, payment as well as any other service available on the site. MAZONIA .
MAZONIA cannot be held responsible for any material, immaterial or bodily damage caused by the misuse of an item purchased on the site.
It is up to the user to check with local authorities the specifics regarding taxes, declarations, prohibitions, possibilities of import or use of the items ordered. The responsibility of MAZONIA cannot be held liable in the event of non-compliance with the legislation of the country where the items will be delivered.
Article 17 – Information technology and freedoms
17.1 – Personal information
The provision of personal information collected in the context of distance selling is mandatory, this information being necessary for the registration, processing, delivery of orders, preparation of invoices and the fight against credit card fraud. This information is strictly confidential. Failure to provide information implies automatic rejection of the order.
In accordance with Law No. 78-17 of January 6, 1978 relating to data processing, files and freedoms, the processing of personal information collected on the site has been declared to the National Commission on Data Protection. 'Informatique et des Libertés (CNIL Declaration) on February 2, 2018 under the number 2148864 v 0. The user has the right to access, modify, rectify and delete data concerning him. Therefore, none of the materials from the Website may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way whatsoever, except under the following conditions: it is possible to download a copy of the materials on a computer for your personal use and for non-commercial purposes only, provided that you do not modify the information and keep intact all copyright and other proprietary notices. The modification of these documents or their use by the Buyers for another purpose constitutes an infringement of the intellectual and industrial property rights of MAZONIA .
Article 19 – Partial disability
In the event that one of the clauses of this contract is null and void by a change in legislation, regulation or by a court decision, this will in no way affect the validity and compliance with these general conditions of sale.
Article 20 – Entire contract
These general conditions of sale and the order summary sent to the buyer form a contractual whole and constitute the entirety of the contractual relations between the parties. In the event of a contradiction between these documents, the General Conditions of Sale will prevail.
Article 21 – Duration
These General Terms and Conditions apply throughout the duration of the online posting of the articles offered by MAZONIA .
Article 22 – Applicable law
These General Terms and Conditions are governed by French law.
In the event of a dispute concerning a product, the user will contact, prior to any dispute, MAZONIA in order to find an amicable solution.
Any dispute to which the General Terms and Conditions may give rise will be brought before the competent courts in accordance with the rules of common law. The competent court is that of the place of the head office of MAZONIA .
